ANJ Issues Record Fine to Unibet for Self-Exclusion Failure
The Autorité Nationale des Jeux (ANJ), France’s gambling regulator, has imposed a historic fine of EUR 800,000 on SPS Betting, the operator behind the Unibet brand in France. The penalty was issued due to a serious self-exclusion failure that put vulnerable players at risk of gambling harm.
The Largest Fine in ANJ’s History
ANJ revealed that Unibet experienced a malfunction related to self-exclusion that lasted for an extended period, allowing self-excluded players to continue placing bets. The issue specifically affected iOS users for nearly two years, from March 2021 to December 2022, before it was eventually rectified. However, further problems resurfaced for another three months until a permanent solution was implemented.
While the exact number of self-excluded players who took advantage of the glitch remains unknown, estimates suggest it could be around 100 players. SPS Betting acknowledged that over 4,500 player accounts were impacted by the malfunction. ANJ, however, reported the figure to be 6,754.
Despite not contesting the findings, SPS Betting was found to be in serious breach of ANJ’s regulations.
Severity of the Violation
Due to the severity of the violation, the prolonged duration of the malfunction, and the inadequacy of initial corrective actions, ANJ decided to impose its largest fine to date. The regulator stressed the importance of self-exclusion in online gaming and the obligation for companies to uphold this crucial aspect of responsible gambling.
Unibet had previously incurred fines in France for breaching the country’s return to player (RTP) limit of 85%, adding to the seriousness of the current penalty.
The operator has a two-month window to appeal the decision and is required to prominently display a message regarding the fine on its homepage.
Unibet’s Troubles Extend Beyond France
Unibet faced further scrutiny in the Netherlands for attempting to block lawsuits from former players who lost money before the company was regulated in the country. This trend of legal challenges from disgruntled gamblers has been growing in regulated markets despite operators’ efforts to combat them.
Meanwhile, France’s gaming industry recently experienced a tax hike on certain gambling products. Although initially considering abandoning the plan, the country ultimately reintroduced the tax increase in its latest budget.
Despite the changes, La Française des Jeux (FDJ), a major player in the French market, remains positive about its business outlook.
